Regulation
Which insurance law applies?
Section 9A of the Insurance Contracts Act 1984 excludes qualifying pleasure-craft insurance from the Marine Insurance Act 1909, with an exception for insurance connected with the craft as cargo. Whether the definition applies depends on ownership and actual or intended use. Do not assume every yacht or every marine policy has the same legal treatment.
Four separate checks
- Contract law: identify the law and terms governing your insurance.
- Vessel rules: check registration, safety and operating requirements with the relevant authority.
- Compulsory insurance: check rules for the vessel category and waters visited, including Queensland's larger-ship rule.
- Private conditions: review marina, mooring, finance and event agreements separately.
What to keep
Keep the PDS version, schedule, endorsements, proposal answers, registration evidence and correspondence together. These records help explain both what was insured and what information was supplied. For a dispute, request the insurer's written reasons and the clause it relies on before considering complaint options.
