Regulation

Claims handling is regulated

ASIC's INFO 253 explains how claims handling and settling services fall within the Australian financial services licensing framework, including authorisations and exceptions. Relevant licensees must provide services efficiently, honestly and fairly. This regulates handling; it does not make every loss insured.

Ask for a clear claim record

  • Get a claim reference and the contact responsible for the next step.
  • Ask what documents remain outstanding and why they are needed.
  • Request written reasons and policy clauses for any disputed decision.
  • Request reports relied on and ask for reasons if access is refused.
  • Keep a dated log of submissions, replies and promised updates.

When to complain

Raise your concern with the insurer's internal dispute resolution team. Describe the outcome you want and distinguish a coverage disagreement from a delay or communication problem. AFCA can consider eligible insurance disputes; check its current limits, timeframes and process rather than assuming every marine dispute qualifies.

General information onlyThe information on sailboatinsurance.com.au is general educational information only. It may be wrong, incomplete or out of date, and you should not rely on it as a substitute for the current policy documents or professional advice. It does not take into account your objectives, financial situation or needs and is not personal financial product advice. Insurance cover depends on the actual policy wording, Product Disclosure Statement, certificate of insurance, endorsements, exclusions, limits, sub-limits and underwriting decisions that apply to your vessel. Always read the current policy documents before buying, renewing or changing cover. For legal, financial or insurance advice about your own circumstances, consider speaking with an appropriately licensed professional.
