Regulation

Unfair contract term protections

ASIC explains that qualifying standard-form consumer and small-business insurance contracts can fall within unfair contract terms protections. The assessment concerns the term, its context and the statutory tests. An unfavourable term is not automatically unlawful, and exclusions from the regime need to be considered.

Section 54 is a separate question

Section 54 of the Insurance Contracts Act concerns certain acts or omissions after the insurance contract was entered into. Its application involves the nature of the restriction, causation and prejudice. It does not simply remove every exclusion or guarantee payment whenever a breach seems unrelated. Get advice on the actual policy and facts before relying on it.

Build a useful dispute record

  • Request the exact clause and written reasons for the decision.
  • Keep the PDS, schedule and endorsement versions applicable to the loss.
  • Prepare a dated account and relevant inspection or expert evidence.
  • State separately why you dispute coverage, the treatment of a condition, or the fairness of a term.
  • Ask about internal dispute resolution and AFCA eligibility.

Continue complying with policy conditions while seeking clarification. Do not treat possible legal arguments as permission to ignore maintenance, navigation or security requirements.
