Private use versus income-producing use

Tax treatment follows use, not intention. A boat used privately is a private asset regardless of how it is owned. A boat genuinely operated to produce income — chartered commercially, for instance — is a different proposition, and the insurance on it is one of many expenses that may be considered.

Mixed-use costs and tax records

  • Assuming that occasional paid charter converts a private boat into a business asset
  • Not apportioning between private and income-producing use
  • Failing to keep the records that would support any apportionment
  • Overlooking that the insurance itself may need to be a commercial policy, not a private one
  • Assuming company or trust ownership changes the character of private use

Commercial use disclosure to insurers

There is an important practical link here. If a vessel is being used commercially, a private pleasure craft policy may not respond at all. Before worrying about deductibility, confirm the policy actually covers the use — a claim declined for unapproved commercial use costs far more than any deduction is worth.

Check the use your policy actually permits

Private, charter, syndicate and commercial use are treated very differently by marine policies. Confirm which one your certificate records before the question ever reaches your accountant.

Frequently asked questions

Can I claim boat insurance if I charter my yacht occasionally?

Possibly in part, but it depends on whether the activity amounts to genuinely producing income, how it is documented, and how private use is apportioned. A registered tax agent needs to assess this — and separately, confirm your insurer permits charter use at all.

Does owning the boat through a company make the insurance deductible?

Not by itself. Tax treatment generally follows how the asset is actually used rather than the ownership structure alone.
