Boat Sale Insurance FAQ: Settlement and Cover Transfers

Answers to boat sale insurance questions: aligning cover with settlement, cancelling the seller’s policy and arranging survey, delivery and registration.

Ownership changes create the two most avoidable gaps in marine insurance: the hours between settlement and cover starting, and the days between a sale agreement and the buyer taking responsibility.

These answers cover the sequence for both sides of a transaction, and the specific situations — survey, sea trial, delivery, finance and import — that sit inside it.

How do I insure a boat I am buying before settlement?

Arrange cover to incept at the moment risk passes under the contract, which is usually settlement rather than delivery. Give the insurer the survey, the purchase price and the intended first passage, and have the certificate of insurance in hand before you hand over the money.

  1. Read the purchase contract to establish when risk passes to you.
  2. Complete the pre-purchase survey and obtain the written report.
  3. Quote the market using the survey's valuation and findings.
  4. Confirm cover to incept at the moment risk passes, in writing.
  5. Add the delivery passage as an extension if it falls outside the limits.
  6. Check the certificate for vessel identity, sum insured and inception before settling.

Read the contract for when risk passes, because it is not always the same moment as payment or possession, and the answer sets your inception time.

Buying a used boat covers the sequence end to end, and new boat insurance covers a purchase from a dealer.

How do I handle insurance during a sea trial?

The vessel is still the seller's, so it is usually their policy that responds — but confirm that before you go out, and confirm whether their cover contemplates a prospective buyer at the helm. A broker or dealer arranging the trial should be able to state the position in writing.

The awkward case is a private sale where the buyer helms during the trial and the seller's policy has an operator condition. Asking the question takes a minute and removes the exposure.

Pre-purchase versus insurance survey covers the inspection stage, and buying a used boat covers the transaction.

How do I cancel my policy when I sell a boat?

Cancel in writing effective the date risk passes to the buyer, not the date you agreed the sale. Provide the insurer with the sale evidence and ask for the pro-rata refund to be confirmed separately. Do not cancel early, because the boat is your risk until it is not.

If there is a financier's interest noted on the policy, that needs releasing as part of the same process or the cancellation can stall.

Selling a boat and insurance covers the sequence and cancelling a policy covers the refund mechanics.

How do I transfer a boat insurance policy to a new owner?

Generally you cannot. Marine policies are written on the owner as well as the vessel, so a sale ends the old policy and the buyer arranges their own. Treat any suggestion that cover simply carries over with suspicion, and get the position in writing from the insurer.

This is different from noting an additional interest or adding a joint owner, both of which are policy amendments rather than transfers.

Selling a boat covers the seller's side and buying a used boat covers the buyer's.

How do I insure a brand new boat from a dealer?

Arrange your own cover to start at handover rather than relying on the dealer's stock policy, and check the settlement basis. New boats are commonly written at agreed value with a new-for-old provision for an initial period, which is worth confirming rather than assuming.

Check also what the dealer's cover does and does not do during the commissioning period, because a boat in the yard being fitted out is in an ambiguous position.

New boat insurance covers handover and the early-years settlement basis.

How do I insure a boat being shipped rather than sailed?

Arrange marine cargo cover for the voyage, which is a different product from a pleasure craft policy. Check who arranges it — the shipping agent often offers it — what the cradle and loading arrangements are, and whether your own policy suspends or continues while the vessel is on the ship.

Loading and unloading is where a disproportionate share of shipping damage happens, so the cover needs to include it rather than just the sea passage.

Boat sea transport insurance covers shipping as cargo, and boat delivery insurance covers the alternative of sailing it.

How do I insure a boat bought at auction or from a deceased estate?

Expect limited or no survey access before purchase, and treat that as the central insurance problem. Arrange cover conditional on a survey within a stated period if the insurer will write it that way, and be candid that the purchase price may not reflect value in either direction.

Cover on an unsurveyed boat of unknown condition is the hardest thing to place, so resolve it before bidding rather than after winning.

Buying a used boat covers the sequence, and insurance without survey covers what is available when no report exists.

How do I register a boat and does it affect insurance?

Register with the state or territory transport authority where the vessel is kept, and consider Australian ship registration separately if you intend to sail overseas. Registration is not an insurance requirement, but the registration paperwork is part of how you evidence ownership on a claim.

Overseas cruising is where the two interact: foreign port authorities generally want registration papers, and some insurers ask about registration status for international cover.

Australian ship registration covers the federal register, and the state guides cover the state requirements.
